How does Live Phish Downloads affect your taping policy?
For the most part, our taping policy remains unchanged. As with other
official Phish releases, you may not copy (except for personal use)
or trade
files offered through Live Phish Downloads. We have made one significant
change to the Policy that bears noting. The Policy now allows for audience
recordings of any show to be traded person to person or through online
repositories, whereas previously it was forbidden to offer audience
recordings of shows that had been officially released through online
repositories. This change applies to live shows released on CD as well
as
via download.
Can I make copies of the Live Phish Downloads?
You may only copy the files you download onto CDs or other devices
for
personal use. Copies are strictly for your own use and you may not
make
additional copies for other people. Making copies of Live Phish Downloads
for others violates our taping policy as well as federal and state
copyright
law. Live Phish Downloads relies on an honor system, and we ask that
you do
not abuse the unrestricted nature of these files. If you would like
to see
this type of delivery of shows continue and flourish, please respect
our
taping policy and don't abuse the system.

Below is a list of Phish's official-release
live shows. In accordance with Phish's policies,
no
version of these shows may be electronically distributed (by file transfer
across computer networks) in any format from now on. People such
as etree.org siteops should remove
any of these dates from their sites. Any existing version except the actual
official release version can still be traded by regular mail or in person
in any format (eg, audio CDs, data CDs of shns, mp3), if you really want
to.
This is an informal list, thrown together as a service to circulation list visitors. If this list has not been updated recently, there is no guarantee that it will reflect all of Phish's off-limits releases. Please check Phish's site for the latest news.
Here is the most relevant section of Phish's statement as of 9/2001:
If we have chosen to offer for sale (via physical media such as CD, or via digital download) a particular Phish performance, this "official" version will take precedence over amateur recordings being offered for download. In these instances, we require that digital audio repositories remove any recording of these particular performances from their collections within 3 days of the official release or 3 days of Phish announcing the intention to release, whichever is earlier. Notwithstanding the above, Phish reserves the right to require immediate removal of any unreleased Phish material. It is the responsibility of the site host to remain informed of the current list of Phish's officially-released recordings and to maintain their site accordingly. In no case may any officially-released Phish recording (live or studio) be duplicated or otherwise traded or offered. Broadcast of unreleased Phish recordings via: radio or online is permissible only if it conforms to all the guidelines applicable to other forms of duplication.
Update 4/3/02: Kevin Shapiro stated (in personal communication to Mike
Wren) that "shows represented on live compilations such as A Live One and
Slip, Stitch and Pass are not prohibited as we did not release the whole
shows."
